Terms of Use
These terms are an agreement between you and Stepping Stone Elite LLC ("we", "us"), the developer of CounterWait. By downloading or using CounterWait, you agree to them. If you don't agree, don't use the app. If you're setting up CounterWait for a child, you agree to these terms for yourself and on the child's behalf, and you're responsible for the child's use.
1. Apple. These terms are between you and us, not Apple. Apple isn't responsible for CounterWait or its content. Your use must also follow the Usage Rules in Apple's Media Services Terms and Conditions. We grant you a limited, non-transferable, revocable license to use CounterWait on Apple devices you own or control, as those Usage Rules allow. Apple has no duty to provide maintenance or support for CounterWait. If CounterWait fails to conform to any warranty that applies, you may notify Apple, and Apple will refund the purchase price, if any. To the fullest extent the law allows, Apple has no other warranty obligation for CounterWait. We, not Apple, are responsible for any claims about CounterWait, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and consumer protection, privacy or similar claims, and for investigating, defending and settling any claim that CounterWait infringes someone's intellectual property. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you aren't located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you aren't on any U.S. government list of prohibited or restricted parties.
2. What CounterWait is. CounterWait helps you limit apps you choose and earn time back with exercise and tasks, alone, as a family, or with accountability buddies. It depends on Apple's Screen Time, iCloud and Health features, which Apple controls and may change. We can't promise that apps will always lock or unlock as expected, that every step or rep will be counted, or that information will sync between phones. Don't rely on CounterWait for safety, emergencies or anything where a failure could cause harm.
3. Health and safety. CounterWait isn't medical, health, fitness or parenting advice, and we aren't doctors or health professionals. Suggested amounts are general starting points based on public guidelines, not advice for any particular person. Rep counting and form tips are camera estimates and can be wrong. Talk to a doctor before starting a new exercise routine, especially if you have a health condition or injury, and stop if anything hurts. Exercise in a safe place. Parents and guardians decide what's right for their children and supervise their exercise. You exercise at your own risk.
4. Families and buddies. If you set up a group, you're responsible for who you invite and for the rules, penalties and limits you set. If you're checked by someone, you agree that they'll see what the app shares with them, as described in the Privacy Policy. Only set up a child's phone if you're that child's parent or legal guardian. Use the accountability features only with people who agreed to them. Don't use CounterWait to monitor or control another adult without their knowledge.
5. The allowance tracker. The allowance tracker only keeps a record of amounts one person says they owe another. CounterWait never holds, sends or receives money and isn't a bank, wallet or payment service. Any payment happens outside the app, between you and the other person, and is your responsibility.
6. CounterWait Plus and tips. Plus is an auto-renewing subscription sold through Apple. The price and period are shown before you buy. Payment is charged to your Apple Account. It renews automatically at the then-current price unless you cancel at least 24 hours before the end of the period. You can manage or cancel it in your Apple Account settings, and it stays active until the end of the period you paid for. Refunds are handled by Apple under Apple's policies. Any free time on Plus we offer is a promotional benefit, has no cash value, and may be changed or ended at any time. Tips are voluntary one-time contributions that don't unlock anything and aren't refundable except as Apple allows. We may change what's included in Plus or its price. Price changes follow Apple's rules for notice and consent.
7. Acceptable use. Don't misuse CounterWait, including by trying to get around another person's rules or passcode without permission, sending false information to someone in your group, harassing anyone, interfering with iCloud or the app, or reverse engineering the app except as the law allows.
8. Our rights. CounterWait, its design, name and logo belong to us or our licensors. These terms don't give you any rights to them except the license above.
9. Disclaimer. To the fullest extent the law allows, CounterWait is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
10. Limitation of liability. To the fullest extent the law allows, we aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, lost time, injury from exercise, or disputes between people in a group. Our total liability for any claim relating to CounterWait is limited to the greater of the amount you paid for CounterWait in the 12 months before the claim and $50. Some places don't allow these limits, so they may not apply to you.
11. Ending. You can stop using CounterWait at any time and delete your information in Settings. We may suspend or stop offering CounterWait, or any feature, at any time. Sections 3, 5 and 7 to 13 continue after these terms end.
12. Law and disputes. These terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Davidson County, North Carolina, and you and we consent to their jurisdiction, except that either of us may bring a claim in small claims court where we live. Nothing in these terms limits rights you have under consumer protection laws that can't be waived.
13. Changes. We may update these terms. We'll change the date above and tell you in the app before material changes take effect. If you keep using CounterWait after that, you accept the updated terms.
